The Ministry of Culture has decided this year to keep an amount of carnival budget to compensate songwriters and performers whose works have been used.

Recall that paragraph 3 of Article 1 of the Decree of 12 October 2005 made the payment a mandatory requirement for any use or public performance. Yet the DJ performances in public places, the revival/use of compositions that are not theirs, the groups participating in the parade, are acts of representation or of public performance ccordance with the definition in paragraph 30 of Article I of the 2005 decree :

The Ministry of Culture pursuant to paragraphs 3 and 4 of Article 7 of the Copyright Decree is constrained to a deduction for the benefit of the Haitian Bureau of Copyright (BHDA), who will make the distribution to authors, composers and performing artists whose works haver been effectively used.

This measure is an act of cultural policy for the protection of literary and artistic property, which is expected to introduce new practices in the market and lay the foundation for the recognition of an economic status to Haitian creators.
